Terms and Conditions
1. Introduction and Scope
These Terms and Conditions govern the use of the danzafutura.com website and the purchase of products and services offered by RITMO DE TRADI SONS – ASSOCIAÇÃO, VAT number (NIPC) PT518859517, registered at R. Rua da Fonte, Nº 282, Barroselas e Carvoeiro, 4905-231 Viana do Castelo, Portugal (hereinafter “the Organizer” or “We”).
By making a purchase through this website or our official ticketing partners, the User agrees to be bound by these Terms and Conditions. Our commercial offering is divided into two distinct categories: physical merchandise and festival tickets.
2. Physical Merchandise (Online Store)
The following conditions apply exclusively to the purchase of physical goods (e.g., clothing, accessories) via our WooCommerce online store:
- Pricing and Payment: All prices are indicated in Euros (€) and include the applicable Value Added Tax (VAT) under Portuguese law. Shipping costs are calculated and displayed at checkout. Payments are processed securely via third-party gateways.
- Order Confirmation: An order is only considered finalized once the payment has been successfully processed and the User receives a confirmation email.
- Shipping and Delivery: Delivery times and conditions are governed by our Shipping & Returns Policy. The risk of loss or damage passes to the User upon physical receipt of the goods.
- Right of Withdrawal (Refunds): In accordance with Decree-Law No. 24/2014, EU customers have the right to return physical merchandise within 14 calendar days of receiving the order, without giving any reason. Items must be unworn and in their original condition. The customer bears the return shipping costs. Please refer to our Shipping & Returns Policy for detailed instructions.
3. Festival Ticketing (Via Shotgun)
The sale of tickets for Danza Futura is delegated to our official ticketing partner, Shotgun. The following terms apply to ticket purchases and event access:
- Purchasing Platform: By clicking to buy a ticket, the User is redirected to Shotgun. The payment, ticketing issuance, and financial transaction are governed by Shotgun’s Terms of Use.
- Exemption from Right of Withdrawal: According to Article 17, paragraph 1, letter k) of the Portuguese Decree-Law No. 24/2014 (and the EU Consumer Rights Directive), the 14-day right of withdrawal does not apply to the provision of services related to leisure activities if the contract provides for a specific date or period of performance. Therefore, all ticket sales are final and non-refundable under normal circumstances.
- Event Cancellation: If the festival is entirely canceled prior to its commencement, the User will be entitled to a refund of the ticket price. Booking or management fees applied by Shotgun are non-refundable, as they correspond to a service already rendered by the platform.
- Lineup Changes: The Organizer reserves the right to alter the lineup, schedule, or specific location within the venue. Such changes do not entitle the User to a refund unless they constitute a fundamental change to the event’s nature.
4. Right of Admission and Venue Rules
The Organizer reserves the right of admission to ensure the safety and normal development of the event.
- Age Restrictions: Access to the festival is restricted to individuals aged 18 and over. Valid physical ID (Passport, National ID, or Driver’s License) must be presented at the entrance.
- Prohibited Items: It is strictly forbidden to bring weapons, sharp objects, glass containers, illegal substances, or any other items deemed dangerous by the security staff.
- Code of Conduct: The Organizer may deny entry or expel any attendee exhibiting violent behavior, severe intoxication, or any attitude that disrupts the event, without the right to a refund.
5. Image Rights and Intellectual Property
By entering the festival venue, attendees grant their express consent to be photographed, filmed, and recorded by the Organizer’s official media teams. The Organizer retains the right to use these images and recordings for promotional, marketing, and commercial purposes (including social media, aftermovies, and website content) worldwide and in perpetuity, without any financial compensation to the attendee.
Professional photography and video recording by attendees are strictly prohibited without prior written press accreditation.
6. Limitation of Liability
The Organizer is not liable for the loss, theft, or damage to personal belongings within the festival venue or parking areas. Furthermore, the Organizer shall not be held responsible for the cancellation or alteration of the event due to force majeure, including but not limited to extreme weather conditions, government mandates, strikes, or public health emergencies.
7. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising from or related to these Terms, the purchase of merchandise, or event attendance shall be subject to the exclusive jurisdiction of the courts of Viana do Castelo, Portugal, without prejudice to any mandatory consumer protection rights that may allow the User to file a claim in their place of residence.
